Chapter I General Provisions

Article I Post-Doctoral Research Center ("The Center") is a scientific research institution established under the approval of the Ministry of Personnel, PRC. The Center is a world-class center of expertise in financial system reform and bank system innovation with studies on forward-looking, key strategic topics of commercial banks carried out by top talents attracted and trained in the Center. The Management Regulations herein are prescribed under Provisions on Post-Doctoral Management promulgated by the Ministry of Personnel, PRC, Interim Provisions on Enterprise Post-Doctoral Work Management (Office of the National Administrative Committee of Post-Doctoral Researchers) and Notice on Amendment to the Organization Structure and Member of ICBC Post-Doctoral Research Center (ICBC).   

Article II Principle of the management of The Center: standardization, strictness, practice, innovation, and pursue excellence.

Article III The Center jointly recruits and trains post-doctoral researchers with domestic famous colleges, universities and scientific research institutions ("Partners"). An Agreement of Joint Training on Post-Doctoral Researchers shall be entered between The Center and Partners in consideration of the responsibilities, rights and obligations of both parties.

The Center and the Partners cooperate with each other on high-level research projects. Cooperation is long-term in line with the professional nature of research projects and the academic excellence of the Partners, supplemented by cooperation on single project. Both partners shall be dedicated to the management of post-doctoral researchers through mutual support and divide the work among both partners.

Article IV The Center shall respect ICBC rules and regulations and under the leadership and management of ICBC.

Chapter II Organization and Functions

Article V  The Center is led by Leading Group - Post-Doctoral Research Center ("Leading Group ") under which are Expert Steering Committee- Post-Doctoral Research Center ("Expert Steering Committee") and Management Office - Post-Doctoral Research Center ("Management Office").

Article VI The Leading Group is made up of ICBC Leaders and senior executives from ICBC Head Office.  1 Head and 1 Deputy Head are ICBC Leaders. Members are senior executives from ICBC Head Office.

The Leading Group is mainly responsible for: review and approve management regulations, line up Partners to cooperate with, approve cooperation agreement, decide research projects, decide the recruitment scale of researchers, screen researchers' list, decide researchers' payroll, welfare benefits and expenses, approve the periodic review and incentive scheme for the researchers, screen the final list of researchers who are qualified to leave the Center, decide the list of unqualified researchers who have to leave the Center, decide the list for Expert Steering Committee, appoint Director of Management Office, other important matters.

Article VII Expert Steering Committee is made up of ICBC Leaders, ICBC experts and experts outside ICBC. There are 1 Chairman (ICBC Leaders), several Vice Chairman and members. Management Office is in charge of the liaison and coordination of the Committee.

Expert Steering Committee is mainly responsible for: evaluate the research plan, review the study papers and the results, assess the standard, preside over dissertation defense, suggest if researchers are qualified to leave the Center; other duties should be exercised.

Experts advising on the post-doctoral research projects are entitled to allowances as stated. Non-ICBC Experts in the Expert Steering Committee are reimbursed all travel expenses as stated in ICBC rules.

Article VIII Management Office of The Center works in the same office of ICBC City Finance Research Institute and is responsible for the day-to-day management of the Center. All liaisons with outside is in the name of Management Office. The Office-in-charge of ICBC City Finance Research Institute also acts as the Director of Management Office.

Management Office is mainly responsible for: finalize the Management Regulations of the Center, finalize yearly recruitment plan of the researchers and project themes; schedule the recruitment announcements, written tests, and interview; finalize the list of researchers enrolled in the Center for approval by Leading Group; arrange project researches; manage daily and review the work of the researchers, finalize the review for approval by Leading Group; approve the research expenses and traveling expenses for the researchers; other duties should be exercised.

Article IX Management Office discusses with Partners to arrange one Advisor for each post-doctoral researcher. The Advisor provides academic guidance on the research project. The Advisor should be Advisor to Ph. D graduates, and has similar research field to post-doctoral researchers. Compensations are determined between ICBC and the Advisor. Travel expenses are reimbursed according to ICBC rules.

Chapter III Research Project and Recruitment Plan

Article X The Center shall draw up a list of proposed research projects of theoretic and practical significance in view of the State financial polices and ICBC reform and development. After discussion with the Partners, proposed projects shall be submitted to Leading Group for review and approval. Once approved, The Center fills in Enterprise Post-Doctoral Research Project Identification List as required and submits it to the Office of the National Administrative Committee of Post-Doctoral Researchers.

Article XI The Center shall prepare a recruitment plan of post-doctoral researchers every year according to the proposed projects and starts recruitment once approved by the Office of the National Administrative Committee of Post-Doctoral Researchers.

Post-doctoral researchers may participate in other projects organized by the Management Office if necessary.

Chapter IV Recruitment of Post-Doctoral Researchers

Article XII The Center recruits post-doctoral researchers from around the world every year, under the principle of "open to all, strict test, only the best".  

Article XIII Any person who has a Ph.D degree, or is going to have a Ph.D degree (proof from university where his/her is studying  that certifies the applicant can obtain the Ph.D degree before he/she joins The Center) in China or any foreign country, or who recently just left other post-doctoral research center are eligible to apply. Applicants shall be 40 years old or below, good integrity, excellent in study, healthy, and study in the field similar to ICBC research projects.  

Article XIV Applicant generally shall be able to work full-time in The Center. The Center does not accept contract or job-targeted researchers.

On-the-job applicants shall submit confirming documentation from his/her company on the consent of his/her joining the Center, together with approval from the Management Office. 

Article XV All applicants have to pass a written test and interview. Written test are closed-book examinations on economics, finance, management and foreign languages. The interview mainly tests the applicant on the subject of the project and his/her oral, listening of the foreign languages. Written test and interview are organized by the Management Office and approved by the Leading Group of the Center. The interviewers are assumed by the members of the Expert Steering Committee or specially engaged experts.

Article XVI Management Office draws up an enrollment list according to the performance of the applicants on their written test and interview. The list will be submitted to the Leading Group for approval after discussion with the Partners. 

Article XVII Once the enrollment list is finalized, the Partners shall gather all the materials and submit them to the Office of the National Administrative Committee of Post-Doctoral Researchers or its local administrative department for review. The Partners help the researcher to enroll into the Center and complete the formalities of his/her residency transfer.

Article XVIII The Center should issue the Enrollment Notice in time. The enrolled post-doctoral researchers shall report to the Center upon receipt of the Notice. Without any other reasons whatsoever, those who fail to report within two weeks after the deadline will be taken as automatic abnegation.

Chapter V Management of Post-Doctoral Researchers

Article XIX The post-doctoral researchers shall be under the same management of ICBC Staff. They shall follow the rules and regulations of ICBC, the Center and the Partners after enrollment.

Article XX In connection with the liability, rights and obligations after enrollment, the post-doctoral researchers shall enter Agreement of Joint Training on Post-Doctoral Researchers with The Center and Partners, in accordance with the provisions stated by Ministry of Personnel of PRC, The Center and Partners. 

Article XXI The post-doctoral researchers shall make detailed plans on the research and submit them to the Management Office for first review. The research can be started once approved by Expert Steering Committee.

Article XXII The post-doctoral researchers shall submit a written report on their research work to the Management Office once every six months and prepare themed academic reports at ICBC.

The Management Office assesses post-doctoral researchers once every six months. Assessment results are submitted to the Leading Group for review and approval and archived into personal files. The Center shall grant awards to those with excellent performance.

Article XXIII After discussion with the Partners and approval by the National Administrative Committee of Post-Doctoral Researchers, the Center shall suspend the research, dismiss the researchers and stop payment on all expenses and welfare benefits in the events of the following:

(I) Disqualified from the regular assessment;
(II) Break rules and regulations and be disciplinary warned or worse;
(III) Stay away from work without taking leave for successive fifteen days or cumulatively for more than one month within one year;
(IV) Find it hard to complete the research due to long-term suffering from sickness;
(V) Go abroad and fail to come back for over a month;
(VI) Fail to complete the research on schedule without any particular reasons;
(VII) Other circumstances under which dismissal is applicable.

Article XXIV During the stay in the Center, researchers are not allowed to apply for overseas post-doctoral research or study. If necessary, the Center shall arrange researchers to go abroad for attending international academic conferences or short-term academic exchange as the circumstance may require, upon approval by the Leading Group of The Center.

Article XXV Period of enrollment is generally two years. Researchers who has completed his/her post-doctoral research work ahead of schedule and made outstanding achievements can leave the Center in advance upon approval by the Center and authorization from the Office of the National Administrative Committee of Post-Doctoral Researchers. If it is absolutely necessary to extend the period for the research, the prolonged period shall be generally not over half a year. The extension has to be reported to the Office of the National Administrative Committee of Post-Doctoral Researchers for filing.

Article XXVI Permanent residence of the post-doctoral researcher is registered at the Center or the Partners. The personnel file and organizational affiliations of the post-doctoral researcher is registered at ICBC Head Office.

Chapter VI Expenses, Salaries and Welfare Benefits

Article XXVII The Center offers not-on-the-job post-doctoral researcher the same salary as an ICBC staffer with a Ph.D degree.

Article XXVIII Each post-doctoral researcher is entitled to a maximum of RMB20, 000 a years for the project expenses. The amount is mainly used to cover the cost of books or materials, attending domestic academic conferences and writing thesis. The Management Office is responsible for reviewing the use of the amount by the researchers. Traveling expenses shall be reimbursed according to the rules upon approval by the Management Office

Article XXIX If applicable, post-doctoral researchers shall apply for funding from China Post-Doctoral Science Foundation in accordance with the rules. The Management Office shall manage the requested funds as stated by China Post-doctoral Science Foundation.

Article XXX The Center pays administrative expenses and expert advisory fees to the Partners as stated in the Agreement of Joint Training on Post-Doctoral Researchers.

Article XXXI The Center provides necessary working conditions for the post-doctoral researchers.

Article XXXII The Center provides necessary furnished housing for the post-doctoral researchers. The post-doctoral researchers shall pay the rental, water, electricity, gas, heating, telephone, management fees and cleaning charges.

Article XXXIII Permanent residence of the spouses and children of post-doctoral researchers, issues of sending their children to nursery or school are settled according to concerning state policies.

Article XXXIV The Center provides not-on-the-job post-doctoral researchers housing provident fund and all insurances as stated. Medical expenses and medical insurance are paid for according to ICBC employees' standard. 

The Center does not provide repeated salaries, housing provident fund and all insurances for on-the-job post-doctoral researchers.

Chapter VII Management of Departure

Article XXXV Before the period of stay in the Center ends, post-doctoral researcher shall complete all research work undertaken and pass all the assessments on the results. The researcher shall make a summary on the research work (including main achievement, awards and publications of thesis) and job performance in two reports: working summary report and research report. After the first review by the Management Office on the reports, a dissertation defense presided by Expert Steering Committee is required upon departure. Those who fail in the first review are not allowed to attend the defense.

Article XXXVI Expert Steering Committee presides over the dissertation defense upon departure of the post-doctoral researchers. Expert Steering Committee evaluates the researchers' results on the academic level, societal and economic benefits. Opinions shall be given on whether to approve their departure ("Dissertation Defense Committee Resolution"). The researchers are allowed to leave the Center once the Resolution approved by the Leading Group. Post-doctoral researchers who disagree with the Resolution will have Leading Group organize another dissertation defense at some other time. Those who fail in the dissertation defense again will be dismissed from the Center.

The Advisors shall not take part in the dissertation defense of the post-doctoral researchers they advised.

Article XXXVII Work summary, review opinions from Management Office, Dissertation Defense Committee Resolution, opinions from Leading Group shall be archived into the Personal File of the researchers.

Article XXXVIII Post-doctoral researchers shall be free to choose to stay in ICBC or look for outside employment after they leave the Center.

ICBC shall choose and employ the best researchers who are about to leave the Center.

Article XXXIX The Center shall prepare all necessary documents for the departure of the researchers as required. The Partners shall summarize all the materials and report to the National Administrative Committee of Post-Doctoral Researchers or its local administrative department and complete all formalities on work assignment and residence transfer.

Post-doctoral researchers shall pay up all rental, water, electricity, gas, heating, management fees and cleaning charges and move out within one month after leaving the Center. The Center shall timely transfer the housing provident fund and all insurances to the new employers of the researchers.

Article XL At the application of the post-doctoral researchers, the Center shall undertake the review of their competence for the senior professional technical position in accordance with the state rules on professional and technical position and post-doctoral work.

Chapter VIII Management of Research Achievement

Article XLI Property rights of the result achieved by post-doctoral researchers are impartially and reasonably protected according to the Intellectual Property Law of China and other regulations:

(I) The Center shall own the intellectual property rights of the result achieved by post-doctoral researcher since the research project, project expenses and day-to-day expenditure are at the expenses of ICBC and the research is mainly completed in the Center.

(II) When research projects are completed at the expenses of both the Center and Partner or in cases that the Partners have transferred the result at the preliminary stage, both parties shall specify in advance the ownership and sharing of the result achieved by the post-doctoral researcher.

(III) Independent or joint publication of thesis, works related to the research topics during the stay in the Center shall have "ICBC Post-Doctoral Research Center" added before the name of post-doctoral researcher.  

Article XLII Researchers shall keep the ICBC and post-doctoral research results confidential as stated in the state regulations and ICBC rules. Otherwise they shall be investigated. During the stay in the Center, researchers shall get prior approval from Management Office as stated in ICBC rules before publication of the research achievement, exchange of results through participation in conferences or acceptance of interview by media.

Chapter IX Supplementary Provisions

Article XLIII The Management Regulations herein shall be submitted to the Office of the National Administrative Committee of Post-Doctoral Researchers for filing.

Article XLIV The Management Regulations herein shall be construed and amended by the Management Office of ICBC Post-Doctoral Research Center.

Article XLV The Management Regulations herein shall enter into force as on the date of printing. Former Management Regulations of Post-Doctoral Research Center shall be void thereafter.

Management Rules of ICBC Post-Doctoral Researcher Recruitment

Article I The Management Rules herein are prescribed under ICBC Post-Doctoral Research Center Management Regulations (Revised) in connection with further recruitment rules and improvement on the management of the Center.

Article II The Center shall draw up a list of forward-looking, operational research projects of theoretic and practical significance in view of the state financial polices, ICBC reform and development and opinions gathered from Expert Steering Committee.

Article III Management Office - Post-Doctoral Research Center ("Management Office") shall prepare yearly recruitment plan and programs against a list of post-doctoral research projects and start recruitment once approved by Leading Group.

Article IV The Center places the advertisement and publishes the list of post-doctoral research projects on ICBC website, economic and financial journals and other media, as stated in the recruitment programs. The Center also announces the recruitment news in major Universities and Research Institutes as Peking University, Tsinghua University, Renmin University of China, Fudan University, and Chinese Academy of Social Sciences.

Article V The Center recruits post-doctoral researchers under the principle of "open to all, strict test, only the best". All recruitments are open, impartial and fair. Post-doctoral researchers are selected from the candidates from around the world in line with the research projects. The recruitment is conducted once in every year.

Article VI Any person who gets a Ph.D degree in China or any foreign country in recent years, or is going to have a Ph.D degree, or recently just leaves other post-doctoral research center are eligible to apply. Applicant shall be 40 years old or below, healthy, excellent in study, and have good integrity, clean records, and the same interest or research background as ICBC research projects.

Article VII Applicants generally shall be able to work in the Center full time. The Center does not accept contract or job-targeted researchers. On-the-job applicant shall submit evidence documentation from his/her former working company on the consent of his/her joining the post-doctoral research and finding employment independently after leaving the Center, together with approval from the Management Office.

Article VIII Applicants shall submit the following application material to the Center: Application Form and Registration Form, thoughts on the selected research topic, photocopy of Ph.D Graduate Certificate and Ph.D Degree Certificate or evidence of Ph.D graduation before enrollment in the Center; doctoral dissertation or dissertation draft, academic publication, photocopy of ID Card, marriage certificate and permanent residence booklet (Card), and other required material.

Article IX All applicants have to pass a written test, interview and second test. Written test are closed-book examinations on economics, finance, management science and foreign language. The interview mainly tests the applicant on the subject of the project and his/her oral, listening of the foreign languages. Written test and interview are organized by the Management Office. Examination officers who score the written test and the interviewers are assumed by the members of the Expert Steering Committee or specially-engaged experts. List of candidates for the written test and interview will be announced on ICBC website in column of "Recruitment"

Article X Management Office shall finalize the list of candidates for second test based on the result of written test and interview. Objective of the second test is to review in detail the applicant's thoughts and plan on the research topic and see if the applicant has the foundation and creativity to complete the research. Management Office shall draw up the enrollment list based on the result of the second test and report to Leading Group for approval.  

Article XI Upon approval of enrollment list by the Leading Group, Management Office and the soon-to-be researcher sign the ICBC Post-Doctoral Researchers Enrollment Agreement ("Enrollment Agreement") to specify clearly the right and obligation of each Party. Terms included in the Enrollment Agreement are mainly Termination and Default.

Article XII Before the soon-to-be researcher officially starts working, The Center reserves the right to terminate Enrollment Agreement in events of the following:

(I) Fail in passing the dissertation defense before entering the Center, or no Ph.D degree was granted upon expiry of the announcement of doctoral dissertation.
(II) Fail in passing the physical examination.
(III) Submit fraudulent Graduate Certificate, academic thesis or other application materials which are different from the truth.
(IV) Being disciplined by the former working company.

Article XIII Soon-to-be researcher shall indemnify as stated in the Enrollment Agreement in the event of default. All indemnity amounts shall be turned into Treasury of ICBC Head Office.

Article XIV The Center should issue the Enrollment Notice in time after soon-to-be researcher signing the Enrollment Agreement. The enrolled researcher shall report to the Center upon receipt of the Notice. Without any other reasons whatsoever, those who fail to report within two weeks after the deadline will be taken as automatic abnegation.

Article XV Once the post-doctoral researcher reports to the Center, Management Office shall prepare all material to joint training partner for summarization. The summary report will be submitted to the National Administrative Committee of Post-Doctoral Researchers or its local administrative department for verification. Management Office shall complete all formalities of residence transfer for the researcher and arrange the researcher to start work in the Center.

Article XVI Once the researcher starts working in the Center, Management Office shall arrange the research plan, advisor and responsible ICBC department. During the stay in the Center, generally researcher's internship in the responsible department is less than a year. The researcher spends the rest of the time in the Center for the research.

Article XVII The Management Rules herein shall be construed and amended by the Management Office of ICBC Post-Doctoral Research Center.
